We at Bothanica Mineral ("BM") are constantly concerned to respect the privacy of our customers ("Users") and demonstrate how your personal data is processed within our online store ("Site").

We have written this document ("Privacy Policies or Policies") to explain how we treat your personal data, but if you still have any questions, you can contact us at alo@bothanicamineral.com.br and we will be happy to answer your questions.

1. SETTINGS

First, we'll show you the definitions of some terms that will appear throughout this document.

1.1 - PERSONAL DATA: information related to a natural person that makes it directly identified or identifiable;

 

1.2 – SENSITIVE PERSONAL DATA: personal data on racial or ethnic origin, religious conviction, political opinion, union membership or organization of a religious, philosophical or political nature, given regarding health or sexual life, genetic or biometric data, when linked to a natural person;

1.3 - HOLDER: individual to whom the personal data that are processed refer;

1.4 – PROCESSING: any operation carried out with personal data, such as those related to the collection, production, reception, classification, use, access, reproduction, transmission, distribution, processing, archiving, storage, deletion, evaluation or control of information, modification, communication, transfer, dissemination or extraction;

1.5 – ANONYMIZATION: use of reasonable technical means available at the time of treatment, through which a data loses the possibility of association, directly or indirectly, with an individual;

1.6 – CONSENT: free, informed and unambiguous manifestation by which the holder agrees to the processing of his personal data for a specific purpose;

 

2. INFORMATION WE COLLECT

Now that you know what we are talking about, we will explain to you what is your personal data that we collect, remembering that we only work with that information essential for the purposes of our website, being certain that other information can be collected and treated in the face of the imposition of standards that apply to our services, as well as through your consent.

2.1 - Data Provided by the User:

a) Registration data on the Site: name, physical address, telephone number and. e-mail. Eventually we may request your ID number (e.g. ID, passport, etc.), CPF number and date of birth, where applicable.

This information is collected so that we can register on the Site and enable the purchase and delivery of the chosen products.

2.2 - Data Collected by the Site:

a) Location Data: When the Site is running, we will collect information related to your location through your device's GPS, as well as through your IP address and mobile and/or wireless network.

 

b) User Profile: When the Site is being used by you, we will collect information about how you use our platform, such as most accessed pages, dates and times of access, and other information related to your use.

This information will be collected in order to ensure the constant quality of existing functionalities on the platform.

c) Transaction Data: BM will not remain with the credit card details used to pay for the services, as well as bank details. In the meantime, we will save a hash code with transaction information, such as date and time of payment.

d) Electronic Device Data: When using the Site, data related to the electronic device you are using will be collected, such as make, model, IP address, operating system, IMEI, mobile network data, among others.

This information will be collected for the purpose of adapting the functionalities of the platform to the device being used by the User.

e) Use of Cookies: When using the BM website, navigation data will be collected through cookies, which will be maintained with BM.

This information will be collected for advertising campaigns with users, such as promotions and discount codes.

3. DATA SHARING

As you already know what types of information we collect, you can now have a question: "will BM share my data with someone else and/or company?". And in this session we will answer that question.

As we said in the beginning, the privacy of our Users is a constant concern. Therefore, we will not share your data with third parties except in the assumptions below. It is important to remember that in such cases, whenever information security depends on BM, we commit to using our best efforts to keep your data in full security.

a) Sharing with the consent of the holder: your data will be shared whenever you expressly request us and/or authorize us to do so;

b) Sharing with companies of the same economic group: we may share your personal data with companies that are part of our economic group, such as subsidiaries, affiliates, related companies or controlling entities.;

c) Sharing with public agencies and public entities: we may share your data with public agencies and public entities (ANVISA, PROCON, etc.) to meet legal and/or regulatory obligations that are imposed on the services we provide, as well as for compliance with any judicial orders imposed;

d) Sharing with law enforcement authorities: we may share your personal data and other information that we deem necessary if, at BM's discretion, any act considered a crime or criminal misdemeanor is suspected, in accordance with the legislation. In this case, the existence of a legal and/or regulatory obligation, as well as a court order, will be expressly waived;

e) Sharing with service providers and business partners: we may share your personal data with service providers and business partners, such as companies that function as payment methods and user relationship tools;

 

4. PROTECTION AND SAFETY

Since you understand what data we collect and what assumptions we're going to share this information with, it's time to know how we're going to keep your data safe and secure.

We use the most modern information security systems on all our systems and devices, which includes the use of technological tools such as encryptions, access controls, firewalls, account creation and access records, among others.

It is important to remember that we only apply these layers of security from the moment your information is received by BM and as long as it is kept with us. Therefore, we cannot guarantee the security of the electronic device or networks you are used to access our platform.

But while we use our best efforts to protect our users' data, we know that incidents can happen. Accordingly, if any of your personal data is exposed in any way, we will send you a notice within a reasonable time with the following information: (i) description of the nature of the personal data affected; (ii) indication of the technical and security measures used for data protection; (iii) risks related to the incident; (iv) reasons for the delay, in the event that the communication was not immediate; and (v) the measures that have been or will be taken to reverse or mitigate the effects of the injury.

 

5. RIGHTS OF THE HOLDERS OF PERSONAL DATA

As the owner of your own personal data, you have several rights that may be exercised at any time and upon direct request directed to BM. Below, we will explain each of these rights, demonstrating our commitment to transparency:

a) Confirmation of the existence of processing: you can send us a request to confirm that we are performing any kind of processing related to your personal data, as well as what data we have about you;

b) Access to the data: in addition to confirming that we are processing your personal data, you can also request access to all the data we have about you;

c) Correction of incomplete, inaccurate or outdated data: if you verify that your data is incomplete, wrong or outdated on our platform, you may request us to correct the information;

d) Anonymization, blocking or deletion of unnecessary, excessive or lawless data: If you understand that we are over-treating data about you, you may request that we anonymize, block or delete such information. About this right, it is important to remember that we will first conduct a query to verify that we really do not need the data that was collected;

e) Data portability to another service provider or product: if you choose to use any competing BM service, you may request us to send all of your information we have with us directly to this new platform. However, we will preserve the trade and industrial secrets that may be involved in the operations;

f) Deletion of personal data processed with the consent of the holder: if you have provided us with your consent to the processing of your personal data, you may request the deletion of that same data, except when we have to keep this information, in accordance with the law, opportunity in which we will inform you about it;

g) Information of public and private entities with which we share your data: you may ask us to detail which public agencies and/or companies we share your personal data with;

h) Information on the possibility of not providing consent and the consequences of the negative: whenever we need your consent for the processing of your personal data, we will inform you about the possibility of not providing us with such authorization, as well as what this may entail;

i) Revocation of consent: you may revoke the consent you provide to us to process your personal data. In the meantime, we may keep information for compliance with laws and/or regulations, in addition to other assumptions expressly provided by law;

 

 

6. MAINTENANCE AND DELETION OF PERSONAL DATA

We will keep your information with us as long as you keep your account on our platform (which we hope will last for a long time!). If you choose to close your account, you may request the deletion of your personal data directly from our communication channels.

We also remind you that even in the face of your request to delete the data, we may keep some information with us in accordance with the legislation in force. In that case, we'll let you know about it. In addition, we may keep your data with us in an anonymized manner and for the exclusive use of BM.

 

7. PRIVACY POLICY UPDATES

We will send you a statement whenever we make any kind of update and/or change to these Privacy Policies and, if your consent is required, we will immediately request.
